Attention All Employers:



The Department of Labor has issued model notices for employees about the Health Insurance Marketplace (also known as the Exchange).  There are two notices available.  One for employers that offer benefits to their employees and the other notice is for employers that do NOT offer benefits to their employees.  There are links below to the notices.

It is very important to note that ALL employers that are subject to the Fair Labor Standards Act (FLSA) MUST issue these notices to ALL employees regardless if they offer health benefits.  Here is what you have to do:

  • Provide the written notice from you to all current employees about Marketplaces by October 1, 2013; you may start notifying them now if you wish. As an employer you must provide the written notice to all new employees at the time of hiring beginning October 1, 2013.

  • You may use the model notices released by DOL (available below) or create your own notice as long as it covers the content requirements outlined in the DOL website .
